Please read these Terms & Conditions carefully before using the www.movebreathebe.co website (“Site”) operated by Move Breathe Be LLC (“MBB”, “it”).

Your access to and use of the Site is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have permission to access the Site.

PURCHASES

If you wish to purchase any product or service made through the Site (“Purchase”), you may be asked to supply certain information relevant to your Purchase, including, but not limited to: your credit card number and expiration date and your billing and shipping addresses. 

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply MBB is true, correct and complete.

The Site may employe use of third-party services for the purpose of facilitating payment for and completion of the Purchase. By submitting your information, you grant MBB the right to provide the information to these third parties subject to MBB’s Privacy Policy.

Move Breathe Be LLC reserves the right to refuse or cancel your Purchase at any time for reasons including, but not limited to: (i) product or service availability; (ii) errors in the description or price of the product or service; (iii) error in your order or (iv) other reasons.

MBB reserves the right to refuse or cancel your Purchase if fraud or an unauthorized or illegal transaction is suspected.

AVAILABILITY, ERRORS & INACCURACIES

Move Breathe Be LLC is constantly updating product and service offerings on the Site. There may be delays in updating information on the Site and in advertising on other websites. The information found on the Site may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, described inaccurately or unavailable on the Site. MBB cannot guarantee the accuracy or completeness of any information on the Site.

MBB therefore reserves the right to change or update information and to correct errors, inaccuracies or omissions at any time without prior notice.

ACCOUNTS

When you create an account with Move Breathe Be LLC, you guarantee that you are above the age of 18 and that the information you provide is accurate, complete and current at all times. Inaccurate, incomplete or obsolete information may result in the immediate termination of your account on the Site.

You are responsible for maintaining the confidentiality of your account and log in information, including, but not limited to: username, password and access to your device and/or account itself. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with the Site or a third-party service. You must notify MBB immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use nor a name or trademark that is subject to any rights of another person or entity other than yourself without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

MBB reserves the right to refuse service, terminate accounts, remove or edit content or cancel orders at its sole discretion.

INTELLECTUAL PROPERTY & COPYRIGHTS

The Site and its original content, features and functionality are and will remain the exclusive property of Move Breathe Be LLC and its licensors. The Site is protected by copyright, trademark and other laws of both the United States and foreign countries. Its trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MBB. With permission, copyrighted material on this website is for non-commercial use only. If you receive written permission, please provide the original link and appropriate credit.

This includes photography. Many of the photos featured on this site are owned by either MBB or several different photographers who own the rights to the photos you see. You do not have the right to use their photos without their written permission. There is no stock photography on this site.

LINKS TO OTHER WEBSITES

The Site may contain links to third-party websites or services that are not owned or controlled by Move Breathe Be LLC. MBB has no control over nor assumes responsibility for the content, privacy policies or practices of any third-party websites or services. It does not warrant the offerings of any of these individuals or entities or their websites.

You acknowledge and agree that MBB shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in conjunction with use of or reliance on any such content, goods or services available on or through any such third-party websites or services.

Move Breathe Be LLC strongly advices you to read the terms & conditions and privacy policies of any third-party websites or services that you visit.

TERMINATION

Move Breathe Be LLC may terminate or suspend your account and bar access to the Site immediately, without prior notice or liability, under its sole discretion, for any reason whatsoever and without limitation, including, but not limited to: a breach of the Terms.

If you wish to terminate your account, you may do so by discontinuing use of the Site.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, but not limited to: (i) ownership provisions, (ii) warranty disclaimers, (iii) indemnity and (iv) limitations of liabilities.

INDEMNIFICATION

You agree to defend, indemnify and hold harmless Move Breathe Be LLC and its licensees and licensors and their employees, contractors, agents, officers and directors from and against any and all claims, damages, obligations, losses, liabilities, costs or debts and expenses (including, but not limited to: attorneys’ fees) resulting from or arising out of: (i) your use and access of the Site by you or any person using your account and password; or (ii) a breach of these Terms.

Specifically, you acknowledge that you are signing up for Coaching or registering for Yoga & Mindfulness at your own risk and waive any claim for personal injury and any other damages that you may have against MBB.

LIMITATION OF LIABILITY

In no event shall Move Breathe Be LLC nor its officers, directors, employees, partners, agents, suppliers or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, including, but not limited to: loss of profits, data, use, goodwill or other intangible losses resulting from: (i) your access to or use of or inability to access or use of the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; or (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or other legal theory, whether or not MBB has been informed of the possibility of such damage and even if a remedy set forth herein is found to have failed of its essential purpose.

The content on the Site is not intended to prevent, diagnose or heal. By purchasing a product or service, you agree that you are participating at your own risk and with the permission of your doctor and that you release Move Breathe Be LLC, Catherine Marquette and any agents, associate, family member and/or heir from any liability in perpetuity.

Specifically, you understand that Coaching is a collaborative process that provides guidance and support but does not guarantee specific results. Coaching is not therapy, counselling or medical advice. You understand that Yoga & Mindfulness requires good physical health to participate in these classes, that participation might cause injury and that you should consult your physician with any concerns. Classes are designed for general self-care and well-being and are not a substitute for medical attention, physical therapy or rehabilitation services.

DISCLAIMER

Your use of the Site is at your sole risk. The Site is provided on an “AS IS” and “AS AVAILABLE” basis. The Site is provided without warranties of any kind, whether expressed or implied, including, but not limited to: implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Move Breathe Be LLC and its subsidiaries, affiliates and licensors do not warrant that: (i) the Site will function uninterrupted, secure or available at any particular time or location; (ii) any errors or defects will be corrected; (iii) the Site is free of viruses or other harmful components; or (iv) the results of using the Site will meet your requirements.

Specifically, some of the newsletters, webpages and/or blog posts may contain affiliate links. Any such page with an affiliate link will be clearly marked with a message at the top of the post that includes a link to this Disclaimer. If you click on an affiliate link and choose to make a purchase, Move Breathe Be LLC may receive a small commission on the sale. Should a webpage allow for comments, please share. Comments that elevate the community are welcome. Move Breathe Be LLC reserves the right to remove any negative comments at its sole discretion.

EXCLUSIONS

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion of limitation of liability for consequential or incidental damages so the limitations above may not apply to you.

GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the District of Columbia, United States of America, without regard to its conflict of law provisions.

Move Breathe Be LLC’s failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement regarding its Site and supersede or replace any prior agreements there might be regarding the Site.

CHANGES

Move Breathe Be LLC reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, MBB will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at MBB’s sole discretion.

By continuing to access or use the Site after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Site.
